Worker's Compensation Reform, Effective February 1, 2014

S.B. 1062 was signed into law by Gov. Mary Fallin and created Title 85A, a new worker’s compensation statute, which fundamentally changed the WC system in Oklahoma.

Effective Feb. 1, 2014, the effects of the Administrative Workers’ Compensation Act include changes in reporting and filing timelines, changes in benefit levels, changes to forms and posted notices among many others. A new notice, CC-Form 1A is attached and should be posted on all work sites and premises. It replaces the old CC-Form 1A.


As of February 1, 2014, many forms for existing WC claims have been revised or replaced. In order to ensure correct forms are used, go to Oklahoma Worker’s Compensation Court of Existing Claims


Timeline changes to be aware of:

Employee has 30 days to report an injury to its employer or injury may be presumed not employment related.


Once the employer is aware of any injury that results in more than 3 days missed work, the employer (NAICO files on your behalf) has 10 days to file the FNOI form, CC Form 2. In order for NAICO to file these timely, we must know about the injury as soon as you do.

NAICO has 15 days after notice to the employer of injury or death to accept or controvert the claim. A compensability decision must be made quickly by the insurance carrier, so NAICO must have prompt notice to have time to properly investigate the claim.


Note: In the past, many employers handled minor claims on their own. Going forward, all claims must be reported to NAICO, or your agent, regardless of how minor the claim may be. This is a departure from the customary procedures in the past for some, as not all claims were reported immediately but reported later after further development. Now, all claims will be compensable if we do not controvert or ask for more time within this 15 day period; therefore, it is critical to inform us of all claims immediately.
